Welcome to FireSnake Fitness ("FireSnake," "we," "us," or "our"). These Terms of Use ("Terms") govern your use of our websites, booking system, and any services offered online or in person (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Acceptance of Related Policies

By agreeing to these Terms, you also agree to our [Privacy Policy] and [Cookie Policy], which are incorporated by reference.

2. Use of the Site

• Use the Site for lawful, personal, and noncommercial purposes only.

• Do not copy, reproduce, distribute, or exploit Site content without written permission.

• If you create an account, keep your login secure. You are responsible for all activity under your account. Notify us right away of any unauthorized use or security issues.

3. Memberships, Payments, and Billing

• Payments for sessions, memberships, or packages are processed by Stripe, our third-party payment processor. By purchasing, you agree to Stripe’s Services Agreement: https://stripe.com/legal

• Some memberships renew on a recurring basis. Renewal price, frequency, and cancellation terms appear at checkout. You can cancel recurring billing by contacting [email protected] or through your client portal before the next renewal.

• Refunds and credits follow our Membership Policies provided at purchase.

4. Intellectual Property

All text, graphics, logos, images, videos, code, and other content on the Site are owned by FireSnake Fitness or its licensors. You may not use our marks or branding without prior written consent.

5. User Generated Content

If you post reviews, comments, photos, videos, or other content ("UGC"):

• You are solely responsible for your UGC.

• You grant FireSnake a worldwide, perpetual, irrevocable, royalty-free, transferable, sub-licensable license to use, host, store, reproduce, modify, create derivative works, publish, display, and distribute your UGC in any media for our business.

• We may remove or block UGC at our discretion if it violates the law, the rights of others, or these Terms.

6. Disclaimers

The Site and services are provided "as is" and "as available" without warranties of any kind. Fitness results vary by individual. The Site does not provide medical advice. Always consult a healthcare professional before starting any EMS training or fitness program.

7. Limitation of Liability

To the fullest extent allowed by law, FireSnake Fitness and its owners, officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services. If liability is found, it is limited to the greater of one hundred dollars ($100) or the amount you paid to FireSnake during the twelve months before the claim.

Some jurisdictions do not allow certain limitations. If a limitation is held invalid, the remaining limitations still apply to the maximum extent allowed by law.

8. Third Party Links and Services

The Site may link to or integrate third-party sites and services we do not control. We are not responsible for their content or policies.

9. Changes to the Site or Terms

We may update or discontinue any part of the Site at any time. We may revise these Terms by posting an updated version with a new effective date. Continued use indicates your acceptance of the revised Terms.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any dispute must be brought in the state or federal courts located in San Diego County, California. You consent to personal jurisdiction in those courts.
